ISSUE STATEMENT FOR #502: EXCESSIVE VIOLENT CRIME

PRESENT CONDITION: The present level of violent crime ( defined as intentional acts which harm or threaten the physical well-being of citizens) is intolerable.

IDEAL CONDITIONS: Citizens should be able to live their lives free from the fear of physical injury due to the intentional acts of other people.

ISSUE JUSTIFICATION : Our Declaration of Independence guarantees each person the right to life, liberty and the pursuit of happiness. Violent crime violates that social contract. Both the actual personal injury of violent crime and the fear of injury reduce the productive output of citizens and misdirect some of the remaining output toward avoiding becoming a crime victim. The resulting loss/misdirection of both human and material wealth is a serious threat to the prosperity of American society.

SOLUTION # 502.1 CRIMINAL POINT SYSTEM FOR LIFE SENTENCE

BRIEF DESCRIPTION: The most effective incentive for criminal rehabilitation and the protection of public safety is the permanent incarceration of repeat criminals. However we need to define the basis for that incarceration. Rather than the present "three strikes" approach, this solution proposes a point system. Independent of the prison term administered by the judicial system, each crime would carry a certain number of criminal points. For example robbery without a deadly weapon = 10 points, but with a gun = 25 points and with injury caused by the gun = 50 points. Repeat offenses for the same or similar crime doubles the points for that offense. There would be a national data bank and crimes in any state or under federal law would be combined on a criminal's record. Good behavior would be rewarded by a 5% annual reduction in points. This compounding 5% reduction would reduce a criminal's points to 60% after 10 years and 36% after 20 years. There would be a national standard defining the minimum lifetime criminal point level for permanent incarceration (e.g. 100 points). Individual states could (if they wanted to attract criminals) set higher limits, but could not set lower limits. Any criminal who exceeded the lifetime point count would be incarcerated for the rest of his life without parole.

JUSTIFICATION: We need to remove dangerous repeat criminals from society, but we need to do it in an intelligent manner. Some crimes clearly justify permanent incarceration on the first offense (e.g. multiple first degree murder) and some (e.g. bicycle theft) may require 10 repeat offenses. If the threat of prison discourages criminal behavior, then we need to "let the punishment fit the crime" to most strongly discourage the worst offenses.

BRIEF DESCRIPTION: Congress shall streamline the process of death sentence appeals so that the sentence can be carried out within a maximum of one year after sentencing.

JUSTIFICATION: While the death sentence is controversial, it has solid support from a majority of the electorate. Therefore the actions of a minority to use the judicial system to thwart popular will must be stopped.

BRIEF DESCRIPTION: Students found carrying guns on school property or within a specified buffer zone shall be sent to a live-in reform school.

JUSTIFICATION: The present level of violence and the threats of violence are disrupting the educational process. An important step is to remove the threat of guns from the school environment.

BRIEF DESCRIPTION: A valid gun registration would be required to purchase ammunition for that type of gun.

JUSTIFICATION: Reducing the level of gun related violent crime requires that only responsible citizens are able to use guns. Controlling the supply of ammunition is one positive step in that direction.

SOLUTION # 502.5 GUN REGISTRATION TO ALL 2ND OWNERS

BRIEF DESCRIPTION: Private sellers of firearms must retain a licensed gun dealer or agent to ensure that the buyer is properly registered. This transaction relieves the seller of responsibility for subsequent use of the gun. Possession of an unlicensed firearm shall be a crime for both the current holder and the original owner if the current holder can identify the original owner.

JUSTIFICATION: The explosion in gun related crime requires the flow of firearms to irresponsible individuals be curtailed. Reducing the number of unregistered 2nd owners would be an important step.

SOLUTION # 502.6 STRINGENT CONCEALED WEAPONS PERMITS

BRIEF DESCRIPTION: Reform current concealed carry laws, so honest citizens can defend themselves. Change current laws so the individual state law inforcement agency (not city or federal govenment) MUST issue permits allowing citizens to carry concealed weapons to citizens that meet the following stringent requirements:

1.must be a legal U.S. citizen living in the state for more than one year

2.must have no felonys or violent misdemenors

3.must pass standard fireams safety and marksmanship test equal to armed guard test

4.must pass written deadly force law test- state shall issue basic law text upon request

5.must have no record of mental illness

6.must be able to legally purchace firearms in accordance with the Brady Bill

JUSTIFICATION: "Concealed carry" laws have helped lower crime rates in Florida and other states. Criminals also fear death like normal citizens, and tend to think twice about confronting a possible armed person. In states that currenty trust their citizens to protect themselves there hasn't been "blood in the streets". Furthermore in areas that deny permits (L.A. ,New York, Washington D.C. )the crime rates continue to skyrocket. The police can not be there all the time,and have no legal reason to protect the individual, (the Supreme Court ruled the police are to protect the society not the individual) so the only one left to save ones family and self is ones self.
